Shop and Establishment

This license is a state based labour license and is to be obtained under the Shops and Establishment Act enacted by the respective state in which the shop or establishment has been set-up.

The license requirement is necessary to fulfill the object of the Shops and Establishments Act, which is essentially the welfare of the employees who work in shops or establishments. This legislation seeks to regulate employment conditions by prescribing payment of wages, opening and closing hours of the shop/establishment, leave, etc.

Applicability & Coverage

  • It applies to all local areas specified in Schedule-I to the Shops and Establishment Act
  • Establishment means any establishment to which the Act applies and any other such establishment to which the State Government may extend the provisions of the Act by notification
  • Employee means a person wholly or principally employed, whether directly or through any agency, whether for wages or other considerations in connection with any establishment

Registration Process

There are certain states in India that offers online registration.
B Other than Individuals and HUF

  • For Individuals and HUF Proof of Identity (Copy of )

Note :-

  • In case of a Minor, any of the above mentioned documents as proof of identity and address of any of parents/guardians of such minor shall be deemed to be the proof of identity and address for the minor applicant.
  • For HUF, an affidavit made by the karta of Hindu Undivided Family stating name, Father’s name and address of the all the coparceners on the date of application and copy of any of the above documents in the name of karta of HUF is required.

Note :-

  • Proof of Address is required for residence address mentioned in item no. 7.
  • In case of an Indian citizen residing outside India, copy of Bank Account Statement in country of residence or copy of Non-resident External (NRE) bank account statements.

  • B. Other than Individuals and HUF
    • Company
    • Copy of Certificate of Registration issued by the Registrar of Companies.

    • Partnership Firm.
    • Copy of certification of Registration issued by the Registrar of Firms or Copy of partnership deed.

    • Limited Liability Partnership.
    • Copy of certification of Registration issued by Registrar of LLPs.

    • Trust
    • Copy of trust deed or copy of certification of registration number issued by Charity commissioner.

    • Association of Person, Body of Individuals, Local Authority, or Artificial Juridical Person.

Copy of Agreement or copy of certification of registration number issued by chrity commissioner or registrar of cooperative society or any other competent authority or any other document originating from any Central or State Government Department establishing identity and address of such person.

REGISTERATION PROCESS

  • For registration of shops/Commercial Establishments under Punjab Shops and Commercials Establishments Act ,1958, the applicant is required to fill up two forms – Form F and Form B.
  • The applicant shall first fill up the Form F and after successful filling up the information under Form F; the applicant shall be directed to fill Form B
  • After the process of filling up the forms, the user shall make the appropriate payment as prescribed under the fee schedule (mentioned in the next page of this document) of the Punjab Shops and Commercial Establishments Act, 1958 depending upon the nature of the business of the Shop/Commercial Establishment.

DOCUMENTS REQUIRE FOR ONLINE REGISTERATION:

  • Detail of the shop/commercial establishment as per Form F & B.
  • Scanned copy of proof of Establishment i.e. Lease Deed/Rent Deed; Registration Deed; or Any other proof of possession of Shop/Commercial Establishment like electricity bill/telephone bill/bank account and affidavit etc.
  • Front photo of shop or commercial establishment covering the surroundings of the said establishment.
  • Use Visa or Master Credit/Debit Card if online payment is to be made.
  • Fee can also be deposited Off-line through any branch of HDFC Bank in the State of Haryana, NCR Region and Mohali (Pb.)
  • Scanned copy of treasury challan if fee is already paid using the Treasury Challan.

Rights of a Copyright holder on Registration

  • Your logo, style, font, get-up, color, scheme of your brand name cannot be copied by any other business firm.
  • The registration certificate is valid for lifetime of the Proprietor of the brand name.
  • If the Copyrighted work is infringed it is a cognizable offence i.e. one can directly file a police complaint to stop the misuse of the work.
  • If the Copyright Registration is done, the complaint / civil suit can be filed at the place where the owner of the Copyright is situated. For Example: if you are situated at Mumbai and some other person is copying your brand name at, say New Delhi. You can file a case at Mumbai. The person who has infringed your brand name will have to appear at the court at Mumbai.
  • To reproduce the work in any material form including the storing of it in any medium including electronic means.
  • To perform the work in public, or communicate it to the public.
  • To make any cinematograph film or sound recording in respect of the work.
  • To make any translation of the work.
  • In case of computer programme the rights also includes to sell or give on hire, any copy of the computer programme
FEE SCHEDULE

The registration fee (fresh or renewal) prescribed hereunder for different categories of establishment is to be paid along with the Application submitted under Form- F and – B
